Texas Debt Law

Defenses and the statute of limitations

What if I'm sued on a time-barred debt anyway?

Short answer

Raise limitations in your Answer; it's a defense you must plead. Suing on a time-barred debt can also violate the FDCPA, Regulation F and the Texas Debt Collection Act, which may support a separate claim against the collector.
