Fulshear is a Fort Bend County city of about 54,629 residents (U.S. Census Bureau, 2024 estimate), and all of it lies in Fort Bend County. That makes the first question easy: a debt lawsuit against a Fulshear resident is almost always a Fort Bend County case. The harder questions are which of the county's courts has it, and how much time you have left.

Texas Debt Law defends people sued by credit card issuers, debt buyers, collection agencies and lenders. Our fees are flat, our phones are answered 7 days a week, and we do most of the work remotely, so you don't have to take time off for every step.

A Justice Court in Fulshear, and Its Twin in Katy

Fort Bend County's justice courts are split into four precincts with seven judges in total. Precinct 1 has two places, and the county's contact pages put them in different towns:

  • Justice of the Peace, Precinct 1, Place 2: listed at 8100 FM 359 South, Fulshear. County contact page.
  • Justice of the Peace, Precinct 1, Place 1: listed at 22333 Grand Corner Drive, Katy. County contact page.

Don't assume your case is in the Fulshear court just because it is closest. The plaintiff files in a particular precinct and place, and the citation says which one. If it names a different Fort Bend precinct, or a court outside Fort Bend County, we check whether the filing was proper. Fort Bend's own venue summary says the general rule is the county and precinct where a defendant lives.

One thing to watch on the county website

When we reviewed it, the Precinct 1, Place 2 debt claim page still described the justice court limit as $10,000. That was the old limit. Justice courts now hear claims up to $20,000 (Gov't Code § 27.031), and other Fort Bend precinct pages show the current figure. Some county pages also describe the answer period differently from the rule. Go by the rules and your citation, and if anything looks inconsistent, ask us.

When the Case Goes to Richmond

Claims above $20,000, such as some auto loan deficiencies, are filed in a higher court. Fort Bend County has six county courts at law and ten district courts; the county lists the district courts at the Fort Bend County Justice Center, 1422 Eugene Heimann Circle in Richmond, the county seat. A creditor can also choose a county court at law for a smaller claim.

The type of court changes your deadline:

  • Justice court: answer by the end of the 14th day after service (Tex. R. Civ. P. 502.5).
  • County court at law or district court: answer by 10:00 a.m. on the Monday after 20 days from service (Tex. R. Civ. P. 99(b)). If the plaintiff later files a motion for summary judgment (on or after March 1, 2026), the response is due 21 days after it is filed (Rule 166a).

Filing Without Going to the Courthouse

The Fulshear court's e-filing page describes electronic filing as a voluntary program open to attorneys and the public for debt claims and other civil filings, with a file-stamped copy returned by email once the clerk accepts it. Filing in person or by mail is still allowed. When we represent you, we file electronically.

How We Approach a Fulshear Debt Case

Every case starts the same way: get a proper answer on file before the deadline. From there, the work depends on who is suing you.

If a debt buyer sued you

Companies that buy charged-off accounts have to show they own your specific account and can prove the balance. We look for gaps in the chain of assignment, records affidavits signed by people with no knowledge of the original lender's records, and balances that don't match the statements. We also check age: Texas generally allows 4 years to sue on a debt (Civ. Prac. & Rem. Code § 16.004), and debt buyers can't sue on time-barred consumer debt (Fin. Code § 392.307).

If the original bank or lender sued you

The original creditor usually has better records, so we focus on the numbers: interest and fees the agreement doesn't allow, payments that weren't credited, and whether the account is really yours.

In either case, if settling serves you better than trial, we negotiate and get the terms in writing. If a collector broke the law along the way, you may have a separate FDCPA or Texas Debt Collection Act claim; that is a separate service from debt defense. See our FDCPA page.

Fulshear Debt Lawsuit FAQs

The papers say "Precinct 1, Place 1." Is that the Fulshear court?

No. Fort Bend lists Place 1 in Katy and Place 2 in Fulshear. Both are Precinct 1 courts, but they are separate courts with separate dockets. File in the one named on your citation.

I have a Katy mailing address but live in Fulshear. Will that confuse things?

It can. Mailing addresses don't follow city or county lines. Katy itself is split among Harris, Fort Bend and Waller counties. What matters is where you actually live and which court the plaintiff chose. Our Katy page explains the three-county issue.

What happens if I already missed the deadline?

Call right away. If no default judgment has been signed yet, an answer can often still be filed. If one has, there may be ways to challenge it, or we can negotiate a post-judgment settlement, which uses the same flat fees as debt defense.

Can they take my house or my paycheck?

Texas protects your homestead and up to $50,000 in personal property ($100,000 for a family) under Property Code chapters 41 and 42, and current wages can't be garnished for consumer debt (Tex. Const. art. XVI, § 28). Non-exempt bank funds are the usual target.
