Schertz is a city of about 44,428 people (U.S. Census Bureau, 2024 estimate) on the northeast side of the San Antonio area, and it reaches into three counties. About 82% of residents live in Guadalupe County, about 14% in Bexar County, and a small part of the city is in Comal County. If you've been sued over a credit card or other consumer debt, your county decides which courthouse has your case, and one of those courthouses may be right here in Schertz.

Texas Debt Law defends Schertz residents in debt lawsuits for flat fees. We handle most cases remotely, by phone, text, email and e-filing, and our phones are answered seven days a week.

Most Schertz Cases: Guadalupe County

The justice court in Schertz

Guadalupe County has four justice of the peace precincts. Precinct 3 has its office on Elbel Road in Schertz. The other three, Precincts 1, 2 and 4, have Seguin addresses. Guadalupe County's justice courts hear civil cases where the amount in controversy is $20,000 or less.

The Precinct 3 page has its own section on debt claim cases. It describes them as suits to recover a debt brought by an assignee of a claim, a debt collector or collection agency, a financial institution, or a lender, for no more than $20,000, governed by Rules 500 through 507 and Rule 508 of the Texas Rules of Civil Procedure. If a debt buyer or bank sued you in Precinct 3, that is the kind of case you have.

County and district courts in Seguin

Bigger Guadalupe County cases go to Seguin, the county seat. The county lists two County Courts at Law and three district courts (the 25th, 2nd 25th and 456th), all at 211 W. Court Street.

The Bexar County Part of Schertz

If your home is in the Bexar County portion, your case is a Bexar County case. Bexar County's Justice of the Peace Courts page lists four precincts, three in San Antonio and Precinct 4 on East Loop 1604 North in Converse, and offers a "Find Your Precinct" tool. Larger Bexar County cases are heard in downtown San Antonio.

The Comal County Part

A small part of Schertz is in Comal County, whose county seat is New Braunfels. Comal County has four justices of the peace and three County Courts at Law. Our New Braunfels page explains how those courts are set up.

The Deadline on Your Citation

Whatever the county, the deadline turns on the kind of court:

  • Justice court (Schertz, Seguin, Converse or elsewhere): answer by the end of the 14th day after service (Tex. R. Civ. P. 502.5).
  • County Court at Law or district court: answer by 10:00 a.m. on the Monday after 20 days have passed since service (Rule 99(b)).

Plug your service date into our answer deadline calculator. Later, if the plaintiff files a summary judgment motion in a county or district court case on or after March 1, 2026, the response is due 21 days after filing (Rule 166a).

What We Do After We're Hired

We answer. Filing a timely answer stops a default judgment and requires the plaintiff to prove its case.

We audit the claim. We look at whether the plaintiff can tie itself to your account through assignment records, whether the balance matches the statements, and whether the suit came too late. The general limit is four years (Civ. Prac. & Rem. Code § 16.004), and a debt buyer can't sue on time-barred consumer debt (Fin. Code § 392.307).

We use the rules. Justice court debt claim cases follow Rule 508, which spells out what the plaintiff must include in its petition and what it needs to prove a default judgment. Gaps there matter.

We resolve it your way. That might mean a trial, a dismissal, or a written settlement you've approved.

Schertz FAQs

Is the Precinct 3 court on Elbel Road a "real" court, or a county office?

It's a real court. A justice of the peace can enter a binding judgment in your debt case, including a default judgment if you don't answer. Treat it as seriously as any courthouse.

I live in Schertz and was sued in Converse. Is that a mistake?

Not if your home is in the Bexar County part of Schertz and in Bexar's Precinct 4. If your home is in Guadalupe County, though, a Bexar County justice court is probably the wrong venue. We'll check.

Do I need to drive to Seguin?

For routine filings, no. We e-file your answer and handle discovery and negotiations remotely. If the court requires you in person, we'll tell you ahead of time.

A collector is threatening to have me arrested. Can they?

No one goes to jail for an unpaid consumer debt in Texas, and a threat like that may violate the FDCPA or the Texas Debt Collection Act. Those claims are a separate service from your defense.

What if there is already a judgment?

Wages can't be garnished for consumer debt in Texas (Tex. Const. art. XVI, § 28), and homestead and personal property exemptions apply (Prop. Code chs. 41 and 42). Bank accounts are exposed. See post-judgment debt settlement.
